Mandatory for every company
Since 12 May 2019, article 34.9 of Spain's Workers' Statute (Estatuto de los Trabajadores) requires a daily record of each employee's start and end time. Company size doesn't matter: it applies even with a single employee.
Kept and available for four years
Records must be kept for four years and be available to employees, their legal representatives and the Labour and Social Security Inspectorate.
Fines from €751 to €7,500
Not keeping the record, or keeping it badly, is a serious offence under article 7.5 of the LISOS. The fine ranges from €751 to €7,500 depending on the grade the Inspectorate applies.
Requirement by requirement
What the law in force (Royal Decree-law 8/2019) requires, what the draft Royal Decree on digital time recording adds (not yet approved), and what Monton already does.
Clocking in shouldn't take more than a click
The time clock lives where your team already logs hours to projects. Nobody opens another app, and you don't chase paper sheets at the end of the month.

What's next: Spain's digital time record
In September 2025 the Spanish government agreed to fast-track a Royal Decree that will make digital time recording mandatory. The draft rules out paper and editable spreadsheets, requires every change to leave a trail of who made it, asks for each entry to say whether it was on-site or remote, and requires remote access for the Labour Inspectorate. As of October 2026 the text has not been approved or published in the BOE. Under the draft it would take effect twenty days after publication, and an adaptation period for SMEs is under discussion.
Until then the 2019 rule applies, and it accepts any reliable, objective and accessible system. Moving to a digital record now saves you two migrations: from paper to software, and from makeshift software to whatever the new decree requires. We'll adapt Monton's time clock to the final text once it's published.
Time clock FAQ
- Is it only mandatory for companies with more than 50 employees?
- No. Article 34.9 of the Workers' Statute applies to every company in Spain with employees, whatever its size or sector. An agency with two employees has the same obligation as one with two hundred.
- Who is exempt?
- Senior management, who have a special employment relationship, and self-employed contractors without an employment contract. Some sectors, such as road transport or the merchant navy, follow their own working-time rules.
- Is a paper sheet or a spreadsheet enough?
- Today, yes, as long as the record is reliable, objective and hard to tamper with; the Inspectorate distrusts records filled in after the fact. Once the Royal Decree currently in progress is approved, paper and editable spreadsheets will no longer be valid.
- Does remote work need to be recorded?
- Yes. The obligation is the same at the office or at home, and Spain's remote work law (Ley 10/2021) says so explicitly. A web time clock like Monton's works the same from anywhere.
- What about part-time contracts?
- They already had a stricter rule before 2019: hours are recorded day by day, totalled every month, and the employee receives a copy of the summary with their payslip (article 12.4.c of the Workers' Statute).
- Does the time clock cost extra in Monton?
- No. It's included in every plan, the free plan too. It isn't a separately priced module.
